Background

Eastern Municipal Water District (EMWD) is permitted to discharge up to 52.5 million gallons per day of recycled water into the Upper Temescal Valley (UTV).  Historically, EMWD only discharges on an intermittent basis when recycled water use is minimal and storage is full during the wet season.  As dischargers to the UTV, EMWD and Elsinore Valley Municipal Water District (EVMWD) were required to develop and implement the UTV Salt and Nutrient Management Plan (SNMP). Since 2013, EMWD and EVMWD have shared the cost for the development and implementation of the UTV SNMP through the Cooperative Agreement Regarding the Development of an UTV SNMP (Cooperative Agreement).

 

The original Cooperative Agreement was approved by the Board in July 2013.  The First Amendment was approved in November 2014, to calculate the substitute ambient water quality. In 2017 and 2018, additional funding was approved to continue SNMP development and incorporate the SNMP into the Santa Ana Regional Basin Plan (Basin Plan).

 

West Yost, formerly Wildermuth Environmental, Inc., developed the SNMP which was approved and incorporated into the Basin Plan on December 4, 2020.  From the development of the SNMP, the approved UTV water quality objectives for Total Dissolved Solids (TDS) and Total Inorganic Nitrogen have been updated to 820 mg/L and 7.9 mg/L, respectively. Implementation of the UTV SNMP now included in the Basin Plan is a necessary step towards increasing EMWDs current NPDES discharge limit of 650 mg/L for TDS to a higher limit.

 

Included with the most recent triennial SNMP update are requirements for continued monitoring and reporting, including the triennial ambient water quality.  In addition, specific management actions to fill the SNMP data gaps have been identified.  These actions are the Storm Water Program Development, Surface Water Monitoring Station Installation, and a Salt Offset Plan.  EMWD and EVMWD will continue to work collaboratively to implement the SNMP through a second amendment to the Cooperative Agreement and equally share the costs as summarized in the following table.

The second amendment of the Cooperative Agreement with EVMWD includes documentation of the SNMP development and implementation activities conducted since 2016 and the activities required through 2023 (Exhibit A).

 

In summary, EMWD will be responsible for funding in Calendar Years (CY) 2021, 2022 and 2023 in the amounts of $160,961, $136,106, and $176,610 for a three-year total of $473,677.  A contingency of 6 percent, or $26,343, was included resulting in a total appropriation request of $500,000.  The total for SNMP development and implementation, since the execution of the original Cooperative Agreement, is $1,856,424, including the prior and current amendments. EMWDs cost since 2013 and through 2023 are $928,212, 50-percent of the SNMP total cost.

 

Exhibit B includes the proposal from West Yost to perform the 2021-2023 SNMP activities. EVMWD will be the administrator of the contract with West Yost, and EMWD will be invoiced for 50-percent reimbursement of the administrative costs. It should be noted that EVMWD is in the process of obtaining a grant to offset the cost of the Surface Water Monitoring Station design and installation.

FINANCIAL IMPACT:

Funding for this item is provided for in the Biennial Budget for Fiscal Years 2021-22 and 2022-23.

 

STRATEGIC PLANNING GOAL/OBJECTIVE:

Water Quality Management: Achieve improved water quality through cost effective supply management, source control, treatment of impaired waters, and salinity management to maximize utilization of recycled water and local water resources.

 

ENVIRONMENTAL IMPACT:

This study is exempt from the California Environmental Quality Act (CEQA) as authorized under the California Code of Regulations, Title 14, Chapter 3, Section 15262, which provides exemption for planning studies.

Recommendation

Approve and authorize execution by the General Manager, or his designee, the second amendment of the Cooperative Agreement with EVMWD for implementing the Upper Temescal Salt and Nutrient Management Plan for the years 2021 to 2023; and appropriation of $500,000 to fund the three year Cooperative Agreement Second Amendment.
