In 2018, due to the retirement of EMWD’s longtime Sacramento advocate, EMWD sought proposals from governmental relations firms to provide state advocacy services to represent EMWD’s interests with state elected and appointed officials, committees and advocacy organizationsThrough a competitive evaluation and selection process, Niemela Pappas & Associates (NPA) was selected and commenced work with EMWD in January 2019.  NPA’s scope over the last year has included full-service advocacy and support of EMWD with the goal of influencing the state legislature to ensure that District’s sponsored or co-sponsored legislation and priorities are represented and advanced.


After a year of working in tandem with NPA, District staff believes the firm has done an excellent job representing EMWD’s priorities in Sacramento and has been very responsive to the District’s needsAs noted above, NPA provides full-service lobbying which includes analysis, policy and legislative strategy development and implementation, relationship-building and maintenance, communication and key representation.  On a day-to-day basis, EMWD’s contract has been served by at least one partner of the firm and one staff lobbyist, with access to NPA’s full team, as needed.  The firm effectively serves as EMWD’s “eyes and ears” in and around the Capitol, and their strategic counsel and key relationships have greatly contributed to EMWD’s success on legislative and policy issues. 


NPA’s existing contract was executed January 1, 2019, and provides the ability to extend the term of the contract for up to two additional years, until December 31, 2021.  NPA has agreed to maintain its retainer rate of $10,000 per month, with a not-to-exceed contract amount of $120,000 annually, for the next two year period.  In addition, the District maintains the right to terminate the contract, with or without cause, upon thirty (30) days written notice.  All other contract terms would remain in effect.  


Financial/Strat Plan/Enviro


Funding for this item is provided for in the Biennial Budget for Fiscal Years 2019-20 and 2020-21.  The final six months of the contract will be included in the next Biennial Budget proposal to the Board in June 2021.

Approve and authorize a two-year agreement extension for state advocacy services with Niemela Pappas & Associates through December 31, 2021, at a cost of $10,000 per month, with a not to exceed annual contract amount of $120,000.
